論文名稱 | 心臟死後器官捐贈的刑法思考 Criminal Issues on the Organ Donation after Death of Heart |

摘要 | 人類生命終期之認定,分別有脈搏停止說 ; 呼吸停止說 ; 綜合判斷說 ; 腦死說等不同主張。近期雖有最高法院將腦死判定準則納為考量,惟多數實務仍係以心臟與呼吸皆永久停止,且瞳孔對光反應停止及放大等徵兆綜合判斷之。衛生福利部日前邀集各界專家召開會議,達成心臟死後器官捐贈的共識。本文認為,病人是否曾簽署器官捐贈同意書,不應對生命價值的絕對保護產生動搖,而應聚焦於開放無心跳器官捐贈之條件是否會脫離生命法益的保護涵攝。此外,應注意如以親屬同意撤除維生醫療,實行同意之親屬與受器官捐贈親屬為同一人時,可能產生的相關倫理爭議。 There are many opinions used to certify the human death like stopped pulse, stopped breath, synthetic judgment and dead brain. Even though supreme court had taken dead brain as the criterion of human death recently, stopped heart and breath with a synthetic judgment that pupils had no reaction to light and even had corectasis are still accepted in legal practice generally. Inviting many scholars in different fields, Ministry of Health and Welfare held a committee to reach a consensus of non-heart-beating donation. The following would be the thesis in this article: the absolute protection of life shall not be effected, whether the patient signed any consent of organ donation. By contrast, it shall be concentrated that whether the legalization of non-heart-beating donation would be excluded from the protected range of life as a legal interest (rechtsgut). Furthermore, an ethical issue shall be noticed that the family member who consents to remove medical care and to donate the organ is the receiver at the same time. |
